The Collision

The wreck occurred while our client was operating an 18‑wheeler for work when another commercial driver drifted out of his lane and collided with her truck.

Following the initial impact, the defendant driver lost control of his vehicle, veered off the highway, crossed an access road, and ultimately came to rest in a ditch.

While the defense initially suggested the collision may have been caused by a tire blowout, further investigation told a different story.

Liability and Investigation

The investigative team conducted a detailed review of the wreck, including video evidence and accident reconstruction analysis. That investigation showed:

  • The defendant’s initial movement into our client’s lane was inconsistent with a tire failure
  • The tire damage occurred after the impact, not before
  • Eyewitness testimony was uncertain and did not support the defense’s version of events

Injuries and Impact

Our client sustained injuries that required evaluation and ongoing treatment, including symptoms consistent with a mild traumatic brain injury, as well as neck and shoulder conditions.

Settlement Process

The case went through multiple rounds of negotiation. At the first mediation, the defense offered no more than $125,000 and took the position that they would not consider a seven‑figure resolution.

Rather than accept that valuation, the legal team continued to develop the case and moved forward.

At the second mediation, the strength of the evidence, expert support, and sustained pressure began to shift negotiations in our favor. The case ultimately resolved for $1,000,000, aligning with our evaluated value range.

The client made the decision to settle, bringing the case to a close and allowing her to move forward with further healing.
