The Crash

The collision occurred on southbound Handley Ederville Road near Highway 121 as our client was traveling through a railroad crossing. The defendant commercial vehicle driver approached from behind and failed to stop in time, rear‑ending our client.

Immediately after the crash, the defendant acknowledged their fault at the scene. Our client also reported that the driver admitted to being distracted shortly before impact.

Although police were not called, both parties exchanged information, and the wreck later proceeded through the legal process.

Going Into Trial

While the fault of the wreck was straightforward, the case carried several difficult factors heading into trial:

  • Minimal visible property damage
  • Defense claims that the injuries were unrelated

Despite these challenges, the case moved forward after pre‑trial settlement offers remained significantly below the value of the claim.

Trial Focus: Causation and Credibility

Because the defendant accepted responsibility for causing the wreck, the trial focused on two key issues:

  • Whether the collision caused the client’s injuries
  • The extent of those injuries and resulting damages

The defense argued that the injuries were minor and attempted to shift some responsibility to the client. James Sung and his legal team addressed these issues head‑on, presenting testimony that explained the timeline, clarified inconsistencies, and connected the injuries directly to the crash.

Notably, the majority of the award reflected noneconomic damage, showing that the jury believed the injuries were genuine, ongoing, and had a meaningful impact on our client’s life.
