The Collision

The collision occurred in December 2023 when a commercial truck struck the rear of our client’s vehicle stopped at an intersection in DeKalb County, Georgia. Our client, an eight-year-old child, was restrained in a rear passenger car seat at the time of the crash. At the scene of the wreck, the commercial driver was cited for following too closely.

Building the Case

Liability was clear from the beginning, but the value of the claim was heavily disputed.

Just weeks before the collision, our client had been diagnosed with a seizure disorder. Following the wreck, she suffered a seizure at the scene and another seizure the following morning, requiring evaluation and treatment at the children’s hospital.

Medical records documented seizure activity immediately following the collision and an increase in frequency and severity, thereafter, resulting in medical treatment.

The evidence focused on how the collision affected the child, who had only recently been diagnosed with a seizure disorder and the concerns created for both her and her family following the crash.

The child's mother and siblings resolved their claims during mediation, but the carrier continued to undervalue the child's claim.

The case ultimately resolved $70,000, seven times greater than the carrier's prior position and a result that left the client and her family very satisfied with the outcome.
