Attorney: Victor Rodriguez

Second Chair: Paige Eldridge

Third Chair: Miguel Cazarez

Case Type: Commercial Rear-End Wreck

Location: Collin County, Texas

Result: $1,069,972.27 Verdict

Witherite Law Group is proud to announce an exceptional verdict of $1,069,972.27 achieved by Attorney Victory Rodriguez and his team. The verdict stands as an example of disciplined trial strategy, relentless preparation, and a refusal to accept less than full accountability from the defense.

Witherite Law Group recently tried this rear-end collision case, resulting in a successful outcome after the defense failed to protect its insured under a limited $30,000 policy. The case involved clear liability, complex medical issues, and a full jury trial in Collin County.

The Wreck

The collision occurred when our client was stopped in traffic and suddenly rear-ended by a commercial vehicle. At the time of the crash, his wife and their 17‑year old son were both in the car, making the impact especially frightening for the entire family. The defense stipulated that their driver caused the crash.

Trial Preparation and Jury Selection

Pretrial work was handled by Miguel Cazarez, who managed motions, witness coordination, and early courtroom proceedings. When trial began, the court set clear expectations and limited each side to six hours, creating a fast paced but fair presentation.

Presenting the Evidence

From opening statements, Victor Rodriguez clearly explained the case to the jury, including the medical care, medical bills, and future care needs, so jurors understood why the damages being requested were significant.

Because of time constraints, several witnesses were presented efficiently on the first day, including:

  • Treating physicians who explained imaging findings, injuries, and treatment
  • Experts who addressed future medical needs and lost wages
  • Witnesses who described how the crash affected our client’s daily life

The medical testimony focused on real-world explanations, using models and plain language to help jurors understand what our client experienced and why his care was necessary.

Defense Testimony and Cross-Examination

On the second day, the defense driver testified and admitted that he took his eyes off the road long enough to fail to notice stopped traffic. Although he attempted to explain the crash by pointing to road conditions, he also acknowledged pleading guilty to a traffic citation related to the collision.

Cross-examination revealed inconsistencies in his testimony, including issues related to recording videos while driving.

Our Client and His Family

The jury also heard from our client and his wife, who described the impact the collision had on his physical health, mental wellbeing, and their marriage.

He was open about his medical history and the challenges he faced after the crash. His wife explained how her role changed after the collision and how the injuries affected their everyday lives. Their testimony helped the jury understand the human side of the case.

Closing Arguments

In closing, Victor Rodriguez focused on the medical evidence, witness credibility, and what the testimony showed, rather than speculation or distractions. The argument emphasized consistency, fairness, and accountability.

The jury was asked to rely on the evidence they heard and saw during the trial.
