The Collision

The collision occurred in March 2024, along IH-35 when traffic slowed due to construction activity. Our clients’ vehicle was traveling south bound in the left lane when a commercial tractor-trailer traveling behind them failed to control speed and rear-ended their vehicle.

The impact caused a chain-reaction collision, pushing our clients’ vehicle into another vehicle ahead.

Investigation and Legal Strategy

Venue strategy also played a critical role. After the case was initially filed in Texas federal court, it was refiled in Illinois federal court following a reassessment of how best to position the matter for litigation and resolution.

The defense questioned whether certain conditions were related to the collision and pointed to the clients’ prior medical history in support of its position.

Those questions remained part of the case as it moved toward resolution.

Settlement and Resolution

Following continued negotiations, the case resolved for $950,000.

After the initial $580,000 offer was rejected, negotiations continued, ultimately resulting in a higher settlement.

The decision to move forward rather than accept the earlier offer led to the increased recovery.
