The Wreck

The collision occurred when our client was driving and was struck head‑on by a commercial vehicle. The defendant was traveling too closely behind other vehicles when traffic came to a stop. To avoid a rear-end collision, the defendant swerved left into oncoming traffic, resulting in a head‑on wreck.

Catastrophic Injuries and a Difficult Medical Course

The injured client suffered catastrophic injuries, including subdural hematoma and extensive trauma to the neck and back. One of the most challenging aspects of the case was the medical timeline.  

With education and care coordination by the legal and client‑care teams, the client underwent four major surgeries involving the neck and back. The seriousness of the condition became unmistakable when the client suddenly lost feeling in both legs and required emergency spinal surgery.

The spouse asserted a loss‑of‑consortium claim, reflecting the profound impact the injuries had on the marriage, daily life, and long‑term plans.  

Early Litigation Challenges and Strategic Venue Change

The case was originally filed in Collin County, where the crash occurred. As litigation progressed, the trial court issued a series of rulings that significantly limited the presentation of damages, including refusing to allow updated medical records or adjusting the trial setting despite the client’s emergency surgery.

With trial approaching and critical evidence excluded, the litigation team reevaluated strategy. Because another claimant had practical claims against a Dallas County defendant, the team made the strategic decision to refile in Dallas County.

Although, with resistance and extensive motion practice from the defense, it repositioned the case in a venue better suited to fairly evaluate the evidence and damages.
