At Witherite Law Group, we pride ourselves on delivering justice even in the toughest trial conditions. Recently, our litigation team secured a $360,000 jury verdict in a highly compressed, high-pressure trial setting where time limits were strict, expectations were heavy, and the defense came to court with four attorneys at counsel table. Despite these hurdles, our team stayed focused, strategic, and relentless, achieving a result more than four times the last offer.

Turning Time Limits Into a Strong Win: The Marshall TrialVictory

Trying a case in front of this court is always demanding, and this trial was no exception. With voir dire cut to 15 minutes and closings limited to 7 minutes, every second counted. Lead Counsel Ray Nichols and second chair Josh Alexander rose to the challenge, delivering a clear, compelling case built on preparation, teamwork, and confident execution.

Voir Dire & Jury Selection

During voir dire, despite having only minutes to work with, Ray secured an engaged and balanced jury panel, men and women of varying ages, including a local personal injury lawyer. The composition of this jury provedvaluable as the case progressed.

Key Case Facts

Our client was traveling in the middle lane of Trinity Mills, a lane designated for both through-traffic and right turns, when a vehicle from the far-right turn-only lane made a wide right turn, colliding into the passenger side of our client’s car. The impact resulted in injuries to the back and wrist, ultimately requiring:

  • Core decompression surgery on the right wrist
  • A future back surgery recommendation supported by an FCE
  • Ongoing pain and functional limitations

Plaintiff’s Case: Strong Medical Testimony

Live and video testimony established causation, injury severity, and future medical needs.

Key highlights included:

  • Expert testimony explaining the necessity of past surgery and future care
  • Clear, accessible medical explanations on causation
  • Solid support from both treating physicians and experts in life care planning and economics

Each witness helped build a cohesive narrative, even underthe tight scheduling imposed by the court.

The Defense Case

The defense heavily contested causation and damages, presenting numerous expert witnesses and attempting to rely on nerve conductionstudies, surveillance-like videos, and cherry-picked medical records. But the jury saw through these tactics. Even with four defense attorneys in thecourtroom, their arguments fell short against our streamlined, consistent presentation.

The Verdict

With only 7 minutes for closing argument, Ray delivered a concise, hard-hitting damages model and walked the jury through the instructions with clarity and purpose.

Defense asked for $45,000. The jury returned with $360,000 after six hours of deliberation.

This verdict demonstrates the power of preparation, clarity, and teamwork, especially when trial time is restricted and the defense throwsevery tactic imaginable at the case.
