Unsafe Driving Causes Fatal Crash with 18-Wheeler

The defendant, driving an 18-wheeler, was driving 65 mph in rain and sleet with his cruise control on when he hit a disabled vehicle. Our client’s teenage daughter was a passenger in that disabled vehicle. Tragically, the impact killed this young, promising college student. The law requires truck drivers to reduce their speed in adverse weather, and industry standards make clear that commercial drivers should not use cruise control in adverse weather.

Our client was traveling on I-20 in Midland, Texas. Traffic ahead slowed, and our client came to a stop. The defendant driver, operating a utility truck for a medical supply company, was distracted by his cell phone and rear-ended our client at 72 mph. Additional investigation revealed the driver had a history of driving over the posted speed limit while on the job. The company, which monitored the utility truck via GPS, knew or should have known its employee habitually sped while on the job—driving all over West Texas and Eastern New Mexico. Our client sustained a traumatic brain injury with a large scalp laceration and injuries to his neck, back, and shoulders. Our client underwent multiple spinal injections and surgery on both shoulders.

Commercial Truck Hits Driver in Heavy Rain

The driver of a commercial truck was driving 65 mph in the right lane of I-35. There was heavy rain, and he should have reduced his speed by a third, given the hazardous road conditions. The truck driver either began to change lanes when unsafe or experienced trailer sway due to his speed and weather conditions. He left his lane and made contact with our client’s vehicle, sending our client into a concrete divider and out of control across the highway. Our client had many pre-existing medical conditions. Unfortunately, the client's injuries were so severe she required a two-level neck fusion and lived with ongoing increased pain in her low back and shoulder before we got to trial. The insurance company for the trucking company offered $25,000 at mediation and offered a top-off of $75,000 after three years of litigation. The client’s medical bills totaled approximately $400,000. Shelly Greco and Victor Rodriguez tried a week-long trial against the out-of-state motor carrier in Tarrant County, Texas. The insurance carrier ultimately tendered its $1M policy limit to resolve the case on the eve of closing arguments.

Lumbar Surgery after Motor Vehicle Wreck

Our client's journey to justice began with a devastating motor vehicle accident, necessitating a lumbar discectomy. Facing staggering medical expenses of around $30,000 and a surgery cost exceeding $50,000, the at-fault driver's insurance company offered a mere $8,426.08. This grossly insufficient amount led us to take decisive legal action against the driver.

As the case unfolded, the insurance company revealed a policy limit of just $30,000 for bodily injury liability and appointed legal defense. Undeterred, our client bravely proceeded with the essential surgery. We then escalated the matter, demanding full compensation from the insurance company, unshackled by the policy limits, citing their failure to act in the policyholder's best interest.

In a surprising twist, the insurance company, fully aware of our client's recent surgery, proposed a settlement of the $30,000 policy limit, to be divided among our client and two others injured in the incident. Recognizing this as another attempt to undermine our client's rightful claim, we rejected this offer.

Our persistence and dedication to our client's cause culminated in a landmark settlement of $179,500. This amount not only covered the lion's share of the medical expenses but also represented a significant stand against unfair insurance practices. Of this settlement, a substantial $164,500 was paid directly by the insurance company, with the remaining $15,000 sourced from the insured's policy limits. This victory underscores our commitment to fighting for our clients' rights and securing the compensation they rightfully deserve.

Our attorneys are always willing to go the extra mile for our clients. In these settlements, our attorneys fought for our clients to get them a higher amount that the policy limit in their cases. We’re not afraid to fight the insurance companies to make sure our clients get everything they deserve.

Shared Fault Crash Between a Bus and 18-Wheeler

Our clients were passengers on a bus heading to Trucking School in the dark, early morning hours. An 18-wheeler, turning from a private driveway, blocked the road due to difficulties managing the tight turn. The bus driver failed to see the stopped 18-wheeler ahead in his lane, even with his headlights on, and crashed into the 18-wheeler's trailer, causing injuries to many of the bus passengers. Client 1 sustained significant low-back injuries requiring multiple spinal injections and eventually, a spinal fusion surgery. Client 2 sustained injuries to his head, neck, and low back, which required emergency room and chiropractic care.

Initially, the bus company refused to accept any responsibility for the crash, while the 18-wheeler company only wanted to take partial responsibility. After suit was filed, depositions of both drivers were taken, which revealed that both drivers were negligent in causing the crash. At mediation, both agreed to share responsibility and ensure our clients were made whole.

18-Wheeler Cuts into Family's Vehicle While Turning

Our client was driving his two children home and had just exited the freeway. At the bottom of the ramp, they were waiting for the light to change to make a left-hand turn. The lane to the right of their vehicle was also a left-hand turning lane, which was occupied by a tractor trailer. When the light turned green, they both began left-hand turns. Unfortunately, the 18-wheeler’s trailer began to cut into our client’s lane. This is known as “off-tracking,” where the trailer does not follow the same path as the tire on the truck but instead makes a sharper turn, often encroaching into the adjacent lane of traffic or even onto sidewalks. The trailer’s rear tandem set of tires struck our client’s car and nearly ripped off the front right wheels of his vehicle. Our client's driver sustained neck injuries, and his children were treated at an emergent care facility and released. After striking our client’s vehicle, the truck driver fled the scene.
