As autonomous vehicle technology continues to expand across major cities, questions about safety, accountability, and regulation remain at the forefront of public debate.

In a recent appearance on the Driving You Crazy podcast with transportation reporter Jason Luber, Amy Witherite, founder of Witherite Law Group, discussed whether robotaxis and other autonomous vehicles should continue operating on public roads before additional safety testing and oversight are in place.

During the conversation, Witherite emphasized that while autonomous technology holds significant promise for reducing crashes and improving transportation in the future, she believes the industry has not yet demonstrated that the technology is ready for widespread public use.

"I do believe eventually the technology is going to make us safer. We're just not there today."

The discussion examined several concerns surrounding autonomous vehicle deployment, including interactions with first responders, performance in unpredictable traffic situations, school zone safety, cybersecurity risks, and the challenges of operating in adverse weather conditions.

Witherite argued that greater transparency is needed from autonomous vehicle companies regarding safety data, testing results, and how driverless systems respond to real-world roadway hazards.

Among her recommendations, Witherite called for:

  • Independent third-party safety assessments
  • Increased transparency surrounding autonomous vehicle performance data
  • Stronger state and federal oversight
  • Additional testing in controlled environments before broader public deployment

The podcast also explored the legal and regulatory questions that may arise as autonomous vehicle technology becomes more common, including issues involving product liability, software failures, manufacturer responsibility, and insurance coverage.

While expressing concerns about current deployments, Witherite stressed that her position is not opposition to the technology itself.

"I don't think it's a forever thing. I do believe self-driving vehicles will get there. I just don't believe we're there today."

As autonomous vehicles continue to enter new markets across the country, the conversation highlights the ongoing challenge of balancing innovation with public safety and accountability.
